These terms and conditions apply to all services provided by AKTHosting and its affiliated entities. AKTHosting is a legally registered company recognized by the relevant authorities. These terms govern all clients ("Subscribers") using our services, whether paid or free. By accessing and using our services, you agree to these terms.
To place an order through our online system, clients must be at least 13 years old and legally capable of entering into this agreement.
If you are under 13, you must immediately notify us and discontinue using our services. You will be prohibited from accessing or using any services offered by AKTHosting.
If you are under 18, you must have consent from a parent or legal guardian to use our services. Additionally, you must confirm that you bypass any security features or age restrictions on our order form. AKTHosting disclaims all responsibility regarding any issues related to age.
To access AKTHosting's control panels, you must provide accurate and complete personal information, which we keep confidential. It is your responsibility to ensure the information is correct. If we find any errors or omissions, we reserve the right to refuse or revoke access to our services at any time, without offering a refund.
Subject to these Terms, we grant you a non-exclusive, non-transferable license to access and use our services for personal, non-commercial purposes only. This license allows you to use our services and any accompanying software on a single device. All other uses are strictly prohibited. We may impose bandwidth limits and expect you to prevent unauthorized access to our services. You agree not to allow individuals under the age of 13 to access our services without parental consent. If you violate any terms, we reserve the right to terminate your access and license. Any data, materials, or software downloaded, printed, or copied from our services must be deleted upon termination of the license. Unauthorized use may lead to legal action, as permitted by applicable law.
AKTHosting will begin setting up your selected services once we receive full payment through our secure online ordering system. An invoice will be provided at least 20 days prior to the due date. It's your responsibility to ensure timely payment and manage any associated fees. Our ordering system is fully secured to protect your payment details.
If your account has an overdue balance for more than 5 days, AKTHosting reserves the right to suspend or terminate your services until full payment is received. You will be notified if this happens. We offer various payment methods for your convenience, including Credit Card, Bitcoin, Wire Transfer, and Cash/Money Order.
AKTHosting does not offer refunds, except in cases covered by our money-back guarantee (as detailed in Section 11) or if there is a billing error.
By choosing the "CREDIT CARD" payment method, you agree to an automated subscription that will activate once your order is completed. This means recurring payments will be automatically deducted from your payment method on each due date. Refunds for automated subscriptions will not be provided unless covered by Section 11 of our terms. If you wish to cancel the subscription, you can either contact our support team via AKTHosting Billing or cancel it from your end. Once a subscription payment is processed, no refunds will be issued, except in cases mentioned in Section 11.
AKTHosting may apply fees to your account if service issues occur. If the issues are due to our fault, no fees will be charged to your account.
For dedicated server rentals, there are no setup fees. Setup fees may be charged if required by a third-party provider or on a case-by-case basis.
AKTHosting offers dedicated server solutions tailored to your needs, ranging from entry-level to high-performance options. Our dedicated servers include various configurations in processing power, RAM, and storage to ensure optimal performance for your business.
Our colocation services provide everything you need, including power supply, rack space, uplink connections, IP allocations, and bandwidth. We also offer reliable IP Transit services to meet your connectivity demands.
AKTHosting offers robust DDoS Mitigation Services, designed to safeguard against all forms of DDoS attacks, including Layer 1 to Layer 6. Our solution specifically targets Level 3 ingress traffic, ensuring your servers are protected from malicious attacks upstream of our Level 3 circuits.
We provide flexible IP Transit options, including carriers like Level 3, Cogent, PCCW, NTT, China Telecom, and China Unicom (availability may vary). These services are available to customers using our colocation services or third-party providers. Please note that clients are responsible for any cross-connect fees associated with these services.
Our web hosting services are powered by our own infrastructure, managed with WHM and cPanel for an efficient and seamless hosting experience. We ensure that your websites are secure and perform at their best.
The materials available through our servers and on any website owned, operated, or licensed by AKTHosting represent our proprietary content and intellectual property. We enforce strict policies against copyright infringement. All content, including software, images, text, videos, audio, and other materials, are registered with the U.S. Copyright Office and protected by copyright laws.
These materials cannot be copied, distributed, modified, republished, uploaded, posted, or transmitted in any form without our prior written consent. You are permitted to print copies of these materials only for personal, non-commercial use. However, you are not allowed to remove, alter, or deface any copyright, trademark, or proprietary notices present on the materials.
Any unauthorized modification or use of our content outside of the terms outlined here constitutes a violation of our intellectual property rights. By using our services, you do not acquire any ownership or rights to our intellectual property. All materials, including text, graphics, images, videos, audio, software, and downloadable content, are owned by AKTHosting or our content providers, and are protected by both U.S. and international copyright laws.
The following types of content or links are considered unacceptable and are prohibited on our platform:
If your account is found to be involved in any illegal activities, such as hosting illegal MP3 files, pirated software, hacking tools, warez programs, or any other unlawful content, your account will be immediately suspended or terminated without notice. Additionally, AKTHosting will report such actions to the appropriate authorities.
AKTHosting reserves the right to take ownership of colocated equipment if the account remains unpaid for over 30 days.
In addition to other rights mentioned in this Agreement, AKTHosting may suspend your services immediately if any payment is overdue.
You are responsible for defending AKTHosting against any claims made by third parties related to the services we provide to you, your use of those services, or any violations of this Agreement.
Failure to make timely payments may result in the suspension or termination of your services without notice. We reserve the right to terminate this Agreement immediately if you violate any of the terms and fail to resolve the issue within seven (7) days after receiving written notice.
In the event of your company entering insolvency, liquidation, or similar financial issues, AKTHosting is entitled to terminate this Agreement immediately. Upon termination or suspension, we may block your website and remove all data. We may delete this data or retain it for a period at our discretion, allowing you to retrieve it at your expense, provided all outstanding amounts are settled.
Any upgrade request you make will not take effect until the beginning of your next billing cycle. If an immediate upgrade is required, the full upgrade cost must be paid upfront. Please note, this payment will not extend or modify your current billing cycle.
Setup for services is typically completed within 24 hours of purchase. However, certain services, like dedicated servers, may take longer. You will be informed of the expected setup time through the order form at the time of purchase.
To cancel your service, please visit https://www.akthosting.com/billing/clientarea.php and submit a cancellation support ticket at least 24 hours before your next billing cycle. Cancellation requests via mIRC or similar channels will not be accepted. Once you submit a cancellation request, your automated subscription will be canceled from our side. By requesting cancellation, you accept responsibility for any charges incurred up to the cancellation point. Please note, no refunds, including membership fees, will be issued, and no credits or time remaining on the service will be refunded or converted into cash. The terms of this Agreement remain active until the service is fully terminated. After cancellation, you will lose access to the non-public areas of our services.
At AKTHosting, we are dedicated to providing excellent service with a 100% uptime guarantee. However, please be aware that setup fees and any other related charges are non-refundable under any circumstances. Our services encompass Bare Metal Servers, VPS Hosting, Colocation, IP Transit, and DDoS Mitigation. If you encounter any issues, including delays in setup or connectivity problems, our technicians are available to assist you promptly.
Our policies are subject to change at any time. It is your responsibility to review this page regularly to stay informed about our Terms of Service (TOS). If you fail to comply with the TOS, we may terminate our agreement with you. No other agreements or contracts will override any part of these Terms. By accepting this TOS, you agree to any changes made without prior notice.
